The client was charged with operating a vehicle with a blood alcohol concentration over 80. We brought a successful Charter application on the basis that his right to counsel had been violated. As a result, the breath test readings were excluded from evidence, and the client was acquitted.

R. v. J.J.

The client was charged with dangerous driving causing bodily harm. After we filed a Charter application under section 11(b) for unreasonable delay—an application that threatened to end the prosecution—the Crown offered a resolution to a Highway Traffic Act offence. This avoided a criminal record and allowed the client to preserve his employment and remain in Canada as a permanent resident.
